I.INTRODUCTIONANDRELIEFREQUESTED
Thisactionarisesoutofayears-longintimaterelationshipbetweentheparties,whichhurtsRespondentdeeplyduetoPetitioner’sliesandabusivetreatment.Formorethansixyears,RespondentwasmisledbyPetitionertobelievethatshewasdatingasinglemanandwasbuildingupacommittedrelationship.ItturnsoutonlyrecentlythatPetitionerhadintentionallyhidden,andcontinuallyliedabout,thefactthathewasamarriedmanandhadatleastonechildfromhismarriage.Afterhislieswereexposed,PetitionerconfessedtoRespondentandacknowledgedthesevereharmhehaddonetoRespondent,healsopromisedRespondentthathewouldprovidesolutionsandlistentoherdemandsfordamages
Butthingschangeddramaticallyafterwards:PetitionerreportedRespondenttopoliceonMay1,2023,andthenfiledthispetitiononMay16,2023foraprotectionorderagainstRespondent.DepictingRespondentasa“occasionalacquaintance…engagedinalimitednumberofcasualsexualencounters”,seethePetition,§7,at2,PetitioneraccusedRespondentofmakingharassingcontacts,exposinghispersonalinformation,andthreatinghisandhisfamilymembers’safety.SeeId.,at§§16-17,at9-10
Thefacts,however,arequitedifferent.Amongotherdetails,thefollowingcriticalfactsweredistortedoromittedinPetitioner’sMay16,2023petition:
1.Petitionerhadinitiated,maintained,anddominatedinasix-strongyear-longdatingrelationshipwithRespondent,andhadinitiatedcontactstoRespondentforsexandother
intimateactivities;
2.PetitionerhadcontinuallyassuredRespondentabouthiscareandlovetoher,anddeniedhewasamarriedman,leadingRespondenttoinvesthertime,money,energy,andemotionintohimandtherelationship;
3.TosatisfyhispersonaldesireindatingRespondent,PetitionerhadviolatedworkethicsandprobablyemploymentpoliciesasanAmazonemployee;
4.PetitionerhadconfessedtoRespondentforhislies,andinvitedRespondenttobringherrequestsanddemand;
5.WhenRespondentattemptedcontactforhisresponse,Petitionerintentionallykeptsilent,andhadnevergivenclearnoticeofnotwantingfurthercontact;
6.Petitionerhasbeenactivelyengagingsocialmediaandseekingpublicattentionandhasvoluntarilydisclosedenormousamountofpersonalinformation;and
7.Beforefilinghispetition,PetitionerknewclearlythatRespondentwasnotthecauseofthealleged“leak”or“exposure”ofhispersonal(includingemployment)information
WhenitbecameclearthatPetitionerhadliedtoher,manipulatedher,andmisledherintoayears-longintoxicatedrelationship,Respondentdidthefollowing:
1.Shewrotedownandpublishherlovestory,hidingparties’namesandpersonalinformation,forself-healingandfarewell,
2.Forthesamepurposes,shequietlyandbrieflyvisitedaplacethatshebelievedtobeassociatedwithherpaininherrelationshipwithPetitioner;
3.SheconfrontedPetitioneranddemandedforapologiesanddamages,andhadonlystartedtocontactPetitionerforresponseafterPetitionerdisappearedandremainedsilenttoherdemands;
4.Whenattackedandinsultedonline,shedefendedherselfbyreportingPetitionerto
thirdpartiesthatshebelievedhadtheauthoritytoconductinvestigationandrevealthetruth
5.Oncelearnedaboutthenatureofthetemporaryprotectionorder,shemadeherbesteffort,includingsubmittingherselftothepolice,tocomplywiththeorder
RespondenthasnotunlawfullyharassedPetitioner,shehasnotinvadedPetitioner’sprivacy,norhassheeverhad“theintenttocoerce,intimidate,orhumiliatePetitioner.”SeeRCW7.105.900(3).WhatshedidarereasonableandjustifiedreactionstowardsPetitioner’slies,hishypocrisy,andhisthreatsandinsultswhenthingswereexposed:toprotectherself,toseekjustice,andtorevealthetruth
Now,thoughRespondenthasdeterminedtopursuelegalactionsagainstPetitionershewillundoubtedlyavoidanyfuturecontactwithPetitionerinherlifeforever.Respondent’shascommittednounlawfulharassmentatPetitioner.Thereisnoneedandnobasisforacivilprotectionordertorestrainher
II.FACTS
RespondentiscurrentlyaninternationalstudentattendingschoolinSeattle
RespondentmetPetitionerMr.KangDaiinSeptember2016,whenshewastravelinginSeattlewasofferedatostayinPetitioner’sapartmentbeforesheleftthecity.Id.?7&Ex.1.ThetwohadsexbeforeRespondentleftSeattle.Id.?8.Thisexperiencestartedadatingrelationshipbetweenthetwoformorethansixyears,withafewintervalsofinterruption.Id.?4
Petitionerhaddominatedthisrelationship.HewastheoneinitiatingcontactstoRespondenttoshowhiscareandlove,sendinginvitationsforholidays’meetingtogether,andrequestingsexandotherinitiateactivitieswithRespondent.Id.??9-14&Ex.2-3.Nodoubt,thejoyandexcitementinsexwaswhatPetitionerwasafter:hetookphotosduringsexwithRespondentwithoutherknowledgeorconsent,Id.??12-13;herequestedRespondenttotakemedicationtodelayperiod(sohecouldhavesexwithoutanywait),Id.?14;heinsistedonhavingsexdespiteRespondentwashavingperiod,Id.?21;andusedviolenceduringsexdespiteRespondent’sreluctance.Id
ButPetitioneralsovowed,formanytimes,forhiscareandlovetoRespondentbeyondsex.Id.??9,15-16,20,Ex.6.Mostimportantly,hekeptassuringRespondentthathewasasinglemansothetwo,aslongascontinuingthedatingrelationship,wouldhavetheopportunitytobefullytogetherultimately.Id.?6&Ex.4.PetitionerwantedtherelationshipwithRespondent;healsomanagedtomaintaintheintimaterelationshipwithRespondentbytakingadvantageofherloveandtrustinhim.Id.??5,16
AfterRespondentmovedtoSeattleforherschool,PetitionerspentmoretimephysicallywithRespondent,treatinghermoreandmorelikealifepartner.Id.??17-20&Ex.5.PetitionertookRespondentintoursandformeals,showedherhisworkplaceandtookherintohisoffice,andvisitedRespondent’sapartmentforintimateactivities.Id
ByMarch2023,Respondentwasstillexpectingtobuildalong-term,seriousrelationshipwithPetitioner–includingmarriage.ButhersuspiciononPetitioner’shonestyandfaithfulnessstartedtogrowrapidlysincelateFebruary,whenshediscoveredevidenceshowingthatPetitionerwasamarriedmanandalreadyhadachildfromhismarriage.Id.?22.Whenconfronted,PetitionerdeniedthathewasmarriedandtoldRespondentthathewantedtocontinuehisrelationshipwithRespondent.Id.?23.Thesuspicion,however,intensifiedinlateMarch2023,whenPetitionerevendeniedhisChinesenametobetheoneRespondenthadlongbelievedandused.Id.?25.Theconfusion,doubts,andinsecuritycausedseriousemotionaldistressonRespondent.Id.?23&Ex.8.InearlyApril2023,Respondentcouldnolongerbearitanddeterminedthatshemustendthisrelationship.Id.?26
Tosayfarewelltothisseven-year-longrelationship,Respondentdidthreethings
First,shewrotedownherlovestoryandposteditonthesocialmediawebsite“LittleRedBook”(inChineseXiaoHongShu)onApril23,2023.Thestorycontainednonameoranyidentifierinformation,Id.?27&Ex.9,butitwasre-postedonotherChinesewebsiteswithoutRespondent’sknowledge.Id.?30&Ex.11.Second,onMay1,2023,shemadeanotherpostonLittleRedBooktitled“Moveon”,expressingherpersonalfeelingsofpainandshock,andherdecisiontoendherrelationshipwithPetitioner.Id.?49&Ex.20.Third,alsoonMay1,2023,accompaniedbyachurchfriend,Respondentpaidavisitto,andstayedabouttenminutesin,theneighborhoodwheresheassumedPetitionerwasresiding.Shetooktwopicturesoftheneighborhoodasshefoundtheviewwasbeautifulandpostedthemonhersocialmediaaccount.Id.?47-48;ThephotoswerepostedinRespondent’sMay1,2023“Moveon”post,butthephoto-takinglocation,showninthepost,wasnotthesamelocationoftheneighborhood.SeethePetition,§Evidence,Appendix5(showing“SwedishIssaquahCa…”);.??48-49.Bypayingthevisit,RespondentdidnotintendtostalkPetitionerorvisitPetitioner’sresidence.Infact,atthetime,shedidnotevenknowforsureifPetitionerreallylivedinthatneighborhood,andsheactuallythoughtPetitionerwasstillinChina.SeeRespondentDecl.??47-48;
OnoraboutMay1,2023,Petitionerreportedtothepolice,accusingRespondent’spostandthedisclosedinformationtherein,includingthepostedneighborhoodpictures,asathreat.Thepolicereportforthiscaseshowedthatinformationwasconsideredtobe“publicinformation”andhadnothreattoPetitioner.?50&Ex.21
AfterRespondentpostedherstoryonLittleRedBook,Petitioner’srealnamewasidentifiedbyunknowninternetusers.Id.?31&Ex.12.Respondentignoredorrejectedtheseinternetusers’suggestionsthatsheshouldexposePetitioneronline,butshecouldnotstopPetitioner’spersonalinformationfrombeingdisclosedandcirculatedonline.Id.??28-29&Ex.10,13.Petitionerhimselfmadeallofthedisclosurepossibleandeasy:heisasocialmediainfluencerandhassharedwiththepublicalotofpersonalinformation,includingphotosofhisfamilymembersandpetdog.Id.?33&Ex.14.Itwasfromthedisclosedinformation,circulatedonlineorsuppliedbyunknowninternetusers,thatRespondentlearnedaboutPetitioner’smaritalstatus,maritalproperty,andemploymentinformation.Id.??31-32&Ex.12
OnApril24,2023,startingfrom2:43a.m.,PetitionercalledRespondent13timesviaWeChatspeakingfor219minutesandsentRespondentabout50WeChatmessages.Inthesecommunications,Petitionerrepeatedlyinsulted,harassed,andthreatenedRespondent.Forinstance,PetitioneryelledatRespondentinhiscalls,threateningwithhisdeath,andhiswife’srevenge.Id.??34-35.PetitioneralsomadedeaththreatsmultipletimestoRespondentandalsothreatenedtoreleaseemailcorrespondencescontainingintimatecontenttothepublic.Id.??34-35,40&Ex.17.RespondentwasexhaustedandscaredbyPetitioner’scallsandthreats.Id.?36
PetitioneralsoknewthatRespondenthadnothingtodowiththecirculationofherlovestoryandtheexposureofhispersonalinformation.Id.?37&Ex.15
DuringthecommunicationviaWeChat,PetitioneralsoattemptedtosecureanotherpersonalmeetingwithRespondentinSeattleinMay2023.Respondentexpresslyrejectedit,andclearlyinformedPetitionerthatshewantedtostayawayfromhimduetoPetitioner’sthreats.Id.?38
IntheeveningofApril24,2023,PetitionercontactedRespondentagainonWeCha
toconfesshisliesabouthismaritalstatus.Id.?39&Ex.16.PetitionertoldResponden
thatshecouldbringupheranydemandsandhewouldcontinuouslylistentoRespondent’scomplaintsanddemands.Id.?39&Ex.16
DuringthelatenightofApril24,2023,RespondentmadeherdemandstoPetitioner
viaWeChat,butshereceivednoresponsefromPetitioner.Id.?41&Ex.18
Atthesametime,Respondentstartedtofindanonymouspostsonlineattackingandinsultingherwithslandersanddefamation.Respondentrepliedsomeoftheattackingpostsonthewebsitetodefendherself.Id.?42-43&Ex.19
OnApril27,2023,findingherselfnotreceivinganyresponsefromPetitionerandtryingtoprotecthercreditabilityandreputationfromtheonlineattack,RespondentsentemailstoindividualsthatshebelievedtobePetitioner’ssupervisorsatworktoreportPetitioner.Id.?44.RespondentwashopingtopromptaninvestigationmadebyaneutralthirdpartythathadauthorityoverPetitioner,torevealthetruthandprovewhatshewascomplainingabout.Id.?45.AmazonInc.repliedtoRespondent’semailadaylater,andalsoinvitedRespondenttoattendameetingwithitsinvestigatoronMay2,2023.Id.?46
InordertoseekPetitioner’sresponsetoherdemandsApril24,2023,RespondentstartedtosendmessagestoPetitionerandcallPetitionerviaWeChattorepeatherdemandsforapologies,compensation,andresolutions.FromMay10,2023throughMay13,2023,RespondentsentafewmessagesonWeChat.Noneofthemessages,however,wasrespondedbyPetitioner.Id.?51.Inthefollowingthreeorfourdays,RespondenttrieddifferentwaystocontactPetitionertoseeifhermessageswerereceivedbyPetitionerandtopromptPetitioner’sresponse,includingmakingtelephonecallstoPetitioners,sendingemails,andsendingmessagesonWeChatandChime.Id.?52
Respondent’slastattempttocontactPetitionerwasmadethroughhersocialmediumaccountat2:59p.m.ofMay18,2023.Id.?53
PetitionerremainedsilentthroughouttheentiretimefromMay10,2023throughMay18,2023.BeforefilingthePetitionandevenbeforeRespondentwasactuallyservedthefullpackageofthetemporaryorder,PetitionerhadnotprovidedanyclearnoticetoRespondentthathedidnotwantfurthercontact.Id.??54-56
ThefullcontentofthetemporaryorderissuedonMay16,2023wasonlyserveduponRespondentinthelateafternoonofMay18,2023.Id.??58-59.Beforeshewasserved,Respondentmadeapostexpressingherconfusion,shock,andpain.Id.?60.Aftershefully
understoodthemeaningofthetemporaryorder,shevoluntarilysubmittedherselftothepolicetoensurefullcompliance.Shehadcompliedtheorder.Id.?61
DuringtheentiretwomonthsofAprilandMay,RespondenthadnevertriedtomeetPetitionerin-person,norhadshestalked,orattemptedtostalk,Petitioneroranyofhisfamilymembers.AllofRespondent’sattemptofcontactingPetitionerinthemonthofMay2023werecausedbyPetitioner’sfailuretofulfillhispromisetolistentoRespondent’scomplaintandhisintentionalsilence.Eventhough,Respondenthasneverintendedtocoerce,intimidate,orhumiliatePetitioner,hergoalsweresimple:toprotectherself,toseekjustice,andtorevealthetruth

III.AUTHORITYANDARGUMEN
A.LegalStandardforIssuingAnti-HarassmentProtectionOrder
“Apetition[maybefiled]foranantiharassmentprotectionorder,whichmustallegetheexistenceofunlawfulharassmentcommittedagainstthepetitionerorpetitionersbytherespondent.”RCW7.105.100(1)(f).Forthepurposeofantiharassmentprotectionorder,“unlawfulharassment”means:“(a)Aknowingandwillfulcourseofconductdirectedataspecificpersonthatseriouslyalarms,annoys,harasses,orisdetrimentaltosuchperson,andthatservesnolegitimateorlawfulpurpose.Thecourseofconductmustbesuchaswouldcauseareasonablepersontosuffersubstantialemotionaldistress,andmustactuallycausesubstantialemotionaldistresstothepetitioner;or(b)Asingleactofviolenceorthreatofviolencedirectedataspecificpersonthatseriouslyalarms,annoys,harasses,orisdetrimentaltosuchperson,andthatservesnolegitimateorlawfulpurpose,whichwouldcauseareasonablepersontosuffersubstantialemotionaldistress,andmustactuallycausesubstantialemotionaldistresstothepetitioner.Asinglethreatofviolencemustinclude:(i)AmaliciousandintentionalthreatasdescribedinRCW9A.36.080(1)(c);1or(ii)thepresenceofafirearmorotherweapon.”RCW7.105.100(36).“Courseofconduct”,then,“meansapatternofconductcomposedofaseriesofactsoveraperiodoftime…evidencingacontinuityofpurpose.”RCW7.105.101(6)(a)(emphasisadded).However,constitutionallyprotectedspeechiscarvedoutfromthedefinitionof“courseofconduct”.SeeRCW7.105.100(6)(a).Further,“[i]ndeterminingwhetherthecourseofconductservesanylegitimateorlawfulpurpose,acourtshouldconsiderwhether:(i)Anycurrentcontactbetweenthepartieswasinitiatedbytherespondentonlyorwasinitiatedbybothparties;(ii)Therespondenthasbeengivenclearnoticethatallfurthercontactwiththepetitionerisunwanted;
(iii)Therespondent'scourseofconductappearsdesignedtoalarm,annoy,orharassthepetitioner;(iv)Therespondentisactingpursuanttoanystatutoryauthorityincluding,butnotlimitedto,actswhicharereasonablynecessaryto:(A)Protectpropertyorlibertyinterests;(B)Enforcethelaw;or(C)Meetspecificstatutorydutiesorrequirements;(v)Therespondent'scourseofconducthasthepurposeoreffectofunreasonablyinterferingwiththepetitioner'sprivacyorthepurposeoreffectofcreatinganintimidating,hostile,oroffensivelivingenvironmentforthepetitioner;or(vi)Contactbytherespondentwiththepetitionerorthepetitioner'sfamilyhasbeenlimitedinanymannerbyanypreviouscourtorder.”RCW7.105.100(6)(b).Lastly,anantiharassmentprotectionordershallbeissuedifthecourt“finds
byapreponderanceoftheevidence”thatthepetitionerhasbeensubjectedtounlawfulharassmentbytherespondent.RCW7.105.225(1)(f).1RCW9A.36.080(1)(c)providesthat“[a]personisguiltyofahatecrimeoffenseifheorshemaliciouslyandintentionally
commitsoneofthefollowingactsbecauseofhisorherperceptionofthevictim'srace,color,religion,ancestry,nationalorigin,gender,sexualorientation,genderexpressionoridentity,ormental,physical,orsensorydisabilityspecificpersonorgroupofpersonsandplacesthatperson,ormembersofthespecificgroupofpersons,inreasonablefearofharmtopersonorproperty.Thefearmustbeafearthatareasonablepersonwouldhaveunderallthecircumstances.Forpurposesofthissection,a“reasonableperson“isareasonablepersonwhoisamemberofthevictim'srace,color,religion,ancestry,nationalorigin,gender,orsexualorientation,orwhohasthesamegenderexpressionoridentity,orthesamemental,physical,orsensorydisabilityasthevictim.Wordsalonedonotconstituteahatecrimeoffenseunlessthecontextorcircumstancessurroundingthewordsindicatethewordsareathreatpersondoesnothavetheabilitytocarryoutthethreat.”(emphasisadded).Threateningwordsdonotconstituteahatecrimeoffenseifitisapparenttothevictimthatthepersondoesnothavetheabilitytocarryoutthethreat.”(emphasisadded)
B.OnlinePosts,Conducts,andDisclosureofInformationAccusedinthePetitionWereNOTMade,orDirectedtoBeMade,byRespondent
